1. Statutory Right of Withdrawal

If you are a consumer and purchase a product through the online shop at ayamicastro.com, you generally have a statutory right of withdrawal of 14 days.

The withdrawal period generally begins when you, or a third party designated by you who is not the carrier, receive the goods.

You do not have to provide a reason for exercising your statutory right of withdrawal.

2. Exceptions to the Right of Withdrawal

The statutory right of withdrawal does not apply where a statutory exception applies.

This includes goods that are not prefabricated and are made according to an individual choice or decision by the customer or are clearly tailored to the customer’s personal requirements.

This may apply to individually commissioned artworks where the legal requirements are met.

The statutory right of withdrawal for standard original artworks, standard prints and other products remains governed by the applicable statutory provisions.

3. How to Exercise Your Right of Withdrawal

To exercise your statutory right of withdrawal, you must inform:

of your decision to withdraw from the contract by means of a clear statement, for example by email or post.

You may use the model withdrawal form below, but you are not required to do so.

4. Return of Goods

If you validly withdraw from a contract, you must return the goods without undue delay and in accordance with the applicable statutory requirements.

The statutory rules concerning the costs and risk of returning goods apply.

5. Refunds

Where a withdrawal is validly exercised, all payments received from the customer, including the applicable standard delivery costs, will be refunded in accordance with the applicable statutory requirements.

The refund will generally be made using the same payment method used for the original transaction, unless another arrangement has been expressly agreed and does not result in any additional costs for the customer.

Michelle Castro Dinis may withhold the refund until the returned goods have been received or the customer has provided evidence that the goods have been returned, whichever occurs first, where permitted by law.

6. Defective or Damaged Goods

The statutory rights relating to defective or damaged goods remain unaffected by this Withdrawal and Returns Policy.

If an order arrives damaged or a product has a defect, please contact ayamicastro@gmail.com as soon as possible and provide details and, where appropriate, photographs of the damage.

Where a replacement is possible, a replacement may be provided. The customer’s statutory rights remain unaffected.
